Privacy Policy of starMedia web site and services

starMedia website” shall mean the multiple web domains and mobile portals related with Orange Horizons Latina, S.A. de C.V. (“starMedia”) offering state-of-art content and services to a generalist Hispanic audience in Latin America and in North America, primary in Spanish language (“ starMedia Website”). starMedia is a company dully incorporated pursuant to the laws of the United Mexican States, with registered office at Jaime Balmes No. 8 Mezanine 2 - Col Los Morales Polanco, 11510 Mexico City.

The “User” shall mean the person, who views any contents made available on starMedia Website and/or has subscribed to or uses any services provided by starMedia.

The purpose of this privacy policy (“Privacy Policy”) is to let the User know how starMedia deals with his privacy and personal information when the User visits and navigates on starMedia Website.

This Privacy Policy refers to: a) the collection, storage and use of Information (as defined below) by starMedia; b) information about cookies, their use and how the User may enable or disable cookies; and c) provisions required to fully comply with Mexican applicable laws.

By browsing and using starMedia Website, the User agrees to be bound by this Privacy Policy, which is incorporated into the Terms of Use of starMedia Website.

starMedia and the User are hereinafter referred to as individually a “Party” and collectively the “Parties”.

Definitions

Information” means together “Personally Identifiable Information” and “Non Personally Identifiable Information” (as such terms are defined below), including all the personal information of the User.

Non Personally Identifiable Information” is information that does not allow to identify the User as an individual and that starMedia may collect when the user navigate or interact with the starMedia Website.

Personally Identifiable Information” is information about the User as individual that allows starMedia to identify him as an individual, including but not limited to name, address and email address.

Collection, Storage and Use of Information

User’s Privacy on starMedia Website

1- Personally Identifiable Information

starMedia may collect and store the Personally Identifiable Information the User expressly provides to starMedia for the purposes of the service(s) for which the User has registered.

The aforementioned Personally Identifiable Information will never include sensitive personal information of the User, such as racial origin, health, genetic information, religious, moral or philosophic beliefs, labor union affiliations, sexual preferences or any other information that could lead to discrimination according to the provisions of the Mexican Federal Law for Protection of Personal Information in Possession of Privates (“Law”).

StarMedia will not disclose or share the User’s Personally Identifiable Information with third parties for any purpose different of the aforementioned.

starMedia collects, processes and uses the User’s Personally Identifiable Information in accordance with all applicable laws, regulations and principle, including the Law. The data controller of the User’s Personally Identifiable Information collected on starMedia Website is Orange Horizons Latina, S.A. de C.V.

starMedia is committed to keep the User’s Personally Identifiable Information accurate and up to date. If the User becomes aware of any errors or if the User would like to see what personal data starMedia has collected from the User, the User may email starMedia at the address provided at the end of this Privacy Policy.

2- Non Personally Identifiable Information

When the User navigates on starMedia Website, starMedia may use cookies or equivalent technologies to collect and store anonymous information about the User’s visit (for example, to gather audience data and count visitors of starMedia Website). The User may refuse the acceptance of such cookies and equivalent technologies by disabling them. To learn more about cookies and how the enable or disable them starMedia invites you to refer to the sections entitles “What is a cookie?” and “How can the User manage or opt out of cookies?”.

starMedia will only collect, process, disclose and share with third parties the User Non Personally Identifiable Information in accordance with applicable law. By using the starMedia Website, the User express its acceptance with the aforementioned collection, process, disclosure and sharing of his Non Personally Identifiable Information.

The User’s Privacy on the advertising spaces of starMedia Website

starMedia provides, through its advertising sale houses or agencies, advertisements on starMedia Website. Collection and processing of all type of Information for the purposes of advertising (in particular, if relevant, targeted advertising) are subject to the privacy policy of such advertising sale houses or agencies, which are available here.

The User, by using the starMedia Website, grants its acceptance in favor of starMedia for using its Information according to the aforementioned Privacy Policy.

How long starMedia keeps the User’s Information

The time period that starMedia keeps the User’s Information will vary depending on how starMedia uses it. The User hereby grants its acceptance in favor of starMedia for using its information for this required period of time.

Unless there is a specific legal requirement to keep the User information, starMedia will not keep it for longer than necessary for the purposes for which the Information was collected or for which it is to be further processed according to article 11 of the Law.

Limitation of Use and Disclosure of Information

If the User wishes to limit use or disclosure of its Information, he or she will be able to send an e mail to the e mail address referred on the last section of this Privacy Policy. In the same way, the User will be able to request access, rectification, cancelation and opposition regarding the use, sharing and disclosure of its Information. starMedia will reply to the User´s request according to the provision of the Law in a term no longer than 20 (twenty) calendar days from the reception of starMedia of the corresponding request. The request, if applicable, will be complied by starMedia in a term no longer than 15 (fifteen) calendar days following the aforementioned reply.

Disclosing the User’s Information to third parties

starMedia reserves the full right to access, share and disclose Information in order to comply with applicable laws, regulations and lawful government requests, to operate starMedia Website properly, to protect itself and its Users or resolve any kind of disputes.

The User hereby grants its acceptance in favor of starMedia for disclosing and sharing its Information to third parties if they are related with starMedia, or if they collaborate, provide any service or work with starMedia in any activity related to starMedia Website. The User agrees that the aforementioned third parties will be able to use its Information outside the country in accordance with this Privacy Policy and the Law.

What is a cookie?

A cookie is a small text file sent by a web server whan the User visits a website and that is stored by your web browser’s device (pc or other) so that it can later be read back from that browser. Cookies may store the User’s preferences and other information but will not identify the User as an individual.

How can the User manage or opt out of cookies?

Most browsers are set by default to accept cookies automatically, but usually the User can modify the settings of his browser to prevent automatic acceptance, to notify the User every time a cookie is sent or to allow the user to choose not to receive cookies at all. In the event the above instructions are incomplete or inaccurate, the User should follow the instructions referenced within the User’s web browser, or contact the browser provider.

Changes to the Privacy Policy

starMedia reserves the right to change, alter or modify this Privacy Policy for any reason at any time. If substantial changes, starMedia will inform the User of such changes, within a reasonable period of time before they become effective, by an information notice made available on starMedia Website and, in case the User provided its email address for the purposes of any Service, by email.

The Use of starMedia Website by User following the implementation of any changes will constitute the User’s binding acceptance of such changes.

Applicable Law – General Provisions

1. If one or more of the stipulations of these Terms of Use proves to be null and void or is declared as such by application of a law or regulation or as a result of a final decision by a competent jurisdiction, the force and scope of the other stipulations shall remain intact.

The stipulations declared null and void or invalid shall then be replaced by stipulations which are as close as possible in content to the stipulations initially set out.

2. The Parties shall not be held liable, or deemed to have failed to comply with these Terms of Use, for any delay or non-execution, when the cause of the delay or non-execution is related to an event of force majeure, as defined by the case law of the Mexican courts.

3. These Terms of Use and all matters regarding their interpretation and/or enforcement shall be governed and construed by the governing laws at Mexico, Federal District. All disputes arising out in connection with these Terms of Use shall be submitted to the jurisdiction of the competent courts in Mexico, Federal District.

Any User’s questions about the handling or protection of its Information or its rights under this Privacy Policy must be forwarded by email via the "Contact us" page at: http://www.starmedia.us/contact/. The department in charge of this e-mail for all purposes referred on this Privacy Policy will be starMedia Editorial Department.
